TERMS AND CONDITIONS OF SERVICE

By engaging the services of ML PRINT PTY LTD (“we,” “us,” or “our”), you agree to the following legally binding terms. Please review them carefully before placing an order.
1. Same‑Day & Express Service
- Limited Scope: Same-Day Service applies only to designated digital products and specific quantities. Bulk orders, offset printing, or complex finishing (e.g., laminating, foiling, die-cutting) are excluded unless explicitly confirmed in writing.
- The "Print-Ready" Clock: Production commences ONLY after:
- Full payment is cleared and received.
- Artwork is approved as "Print-Ready" by our production team in writing (meeting all technical specs).
- 10:00 AM Cut-off: All requirements must be met by 10:00 AM (AEST) on a business day. Any delay in file correction, approval, or payment will automatically push the production/dispatch to the following business day.
- Capacity & Force Majeure: We reserve the right to downgrade an Express order to Standard Turnaround (refunding only the express surcharge) if technical issues, machine maintenance, or stock shortages occur.
2. Artwork & Production Responsibility
- Technical Compliance: You are solely responsible for ensuring artwork is in CMYK mode, at least 300 DPI, and includes a minimum 3mm bleed. We are not liable for quality issues (pixelation, banding, or colour shifts) arising from non-compliant files.
- Final Proofing: Your written/digital approval of a proof is FINAL and BINDING. ML PRINT is not responsible for any errors (typos, layout flaws, or incorrect details) regardless of how they were introduced, once the proof is approved.
- Colour & Stock Variance:
- Minor colour variations between digital screens (RGB) and physical print (CMYK) are an industry standard and do not constitute a defect.
- We reserve the right to substitute paper stocks with a comparable alternative of similar quality if the specified stock is unavailable.
3. Payment & Refund Policy
- Pre-payment: All orders must be paid in full before production commences. Title to the goods remains with ML PRINT until payment is received in full.
- Custom Nature of Goods: Due to the bespoke nature of printed products, all sales are final.
- Claims & Remedy: Reprints or credits are only issued if a clear production error is found to be solely the fault of ML PRINT. Claims must be lodged within 48 hours of receiving the goods. Defective goods must be returned to ML PRINT in full before a remedy is provided.
4. Shipping, Delivery & Collection
- Third-Party Risk: While we guarantee on-time dispatch, risk in the goods passes to the Customer upon dispatch. We are not liable for delays, losses, or damages caused by third-party carriers (e.g., Australia Post, StarTrack).
- Collection: Orders for "Local Pickup" must be collected within 14 business days. Goods not collected within 30 days may be destroyed or recycled, and the Customer remains liable for the full invoice value.
5. Intellectual Property & Indemnity
- Customer Warranty: You warrant that you own the legal rights or have permission for all content provided.
- Indemnity: You agree to indemnify and hold ML PRINT PTY LTD harmless against any legal claims, costs, or expenses arising from copyright or trademark infringement within your artwork.
- Right to Refuse: We reserve the right to refuse any job that contains illegal, libelous, or offensive material.
6. Limitation of Liability
- Liability Cap: To the maximum extent permitted by NSW law, our total liability is strictly limited to the invoice value of the specific order.
- No Consequential Loss: ML PRINT is not liable for any indirect or consequential loss, including but not limited to loss of profits, business interruption, or event cancellation costs arising from missed deadlines or defective goods.
7. Governing Law
- Jurisdiction: These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved within the jurisdiction of NSW courts.
